3. Scope of Use and Site Access

We grant you a limited, revocable, non-transferable, and non-exclusive license to access and make personal use of this Site in accordance with these Terms. This license does not include any right to:

• Resell or Commercial Use: You may not reproduce, duplicate, copy, sell, trade, or otherwise exploit the Site or any portion of it for any commercial purpose without our express written consent. The Site is intended for your personal, non-commercial use (such as browsing properties, making legitimate bookings, or learning about our services).
• Modify or Derivative Use: You may not modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Site or its content. Similarly, you may not create derivative works from the Site’s content.
• Data Extraction: You are expressly prohibited from using any data mining, robots, scraping, or similar data gathering or extraction methods on the Site, except with our prior written consent. • Interference: You must not interfere or attempt to interfere with the proper working of the Site. This includes not attempting to bypass any security measures, not introducing any viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, and not attacking the Site via a denial-of-service attack or similar.

We reserve the right, in our sole discretion, to terminate or suspend your access to the Site (or certain features of it) at any time, without notice, if we believe you have violated these Terms or engaged in any fraudulent or unlawful activity.

4. Account Registration (if applicable)

Our Site may allow you to create an account or profile (for example, to save wishlists or manage bookings). If you choose to register:

• Provide Accurate Information: You agree to provide truthful, accurate, current, and complete information about yourself as prompted by the registration form. Keeping your information updated is also your responsibility.
• Account Security: You are responsible for maintaining the confidentiality of your account login credentials (username and password). You should not share your password with anyone. You agree to notify us immediately at support@skyuniverse.com if you suspect any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to protect your account credentials.
• Account Use: You are responsible for all activities that occur under your account. All usage of your account must comply with these Terms. If someone else is using your account, we will assume it is you, so please guard your details closely. You must not use another person’s account without permission.
• Termination of Account: We reserve the right to suspend or terminate your account at any time if we reasonably suspect that you have violated these Terms or engaged in fraudulent or illegal activity. You can also request to cancel your account by contacting us. Keep in mind that even if an account is terminated, these Terms (and any obligations or liabilities you incurred) may still apply.

5. User Conduct and Acceptable Use

When using our Site, you agree to conduct yourself lawfully and respectfully. You must not:

• Violate Laws or Rights: Use the Site in any way that violates any applicable law or regulation, or that infringes upon the rights of others (including intellectual property rights and privacy rights).
• Submit Harmful Content: Post or transmit any content through the Site that is unlawful, harmful, defamatory, obscene, pornographic, indecent, lewd, harassing, threatening, inflammatory, fraudulent, or otherwise objectionable. (Note: Our site’s primary content is provided by us — users typically can only submit information in forms or chat relevant to inquiries/bookings. Regardless, any communication you send us must be appropriate.)
• Impersonation and Misrepresentation: You may not impersonate any person or entity, or falsely state or otherwise misrepresent your identity or affiliation with a person or entity (including pretending to be a representative of Sky Universe if you are not).
• Disruptive Activities: Engage in any conduct that could disable, overburden, or impair the proper working of the Site or servers (e.g., a flood attack). You also agree not to use any device, software, or routine that interferes with the proper operation of the Site, or attempt to probe, scan, or test the vulnerability of our systems without authorization.
• Unauthorized Access: Attempt to gain unauthorized access to any portion or feature of the Site, other user accounts, or any systems or networks connected to the Site, through hacking, password mining, or any other illegitimate means.
• Malicious Code: Upload, transmit, or distribute any viruses, worms, malware, or any other code that is malicious or harmful. Introducing such material is strictly prohibited and may result in legal action.
• Data Harvesting: Collect or harvest any information about other users of the Site (such as personal data or information about their bookings) without their consent and without complying with applicable data protection laws. This includes not scraping user data or our content.
• Commercial Solicitation: You may not use the Site to advertise or solicit for any commercial purpose not explicitly authorized by Sky Universe. For example, you cannot use our contact forms or chat to send spam, promotional materials, or junk mail to us or other users.

We expect users to use our Site primarily for its intended purpose: finding and booking rental accommodations and learning about our services. Any misuse of the Site contrary to these Terms may result in termination of your access, and if necessary, we will involve law enforcement or pursue legal remedies.

6. User-Provided Content

Our Site might allow certain user-generated input (for example, perhaps reviews, comments, or profile information). In general, currently our website functions do not include public forums or comment sections; however, if in the future we allow you to submit or post content on the Site (e.g., posting a review or uploading a profile picture), the following terms would apply:

• Your License to Us: By submitting any content (text, images, reviews, etc.) to our Site, you grant Sky Universe Ltd a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with operating or marketing the Site and our services. For example, if you provide a testimonial or review, we may display it on our Site or in marketing materials (using only your first name or initials for privacy, unless you asked to remain anonymous). You represent that you have all necessary rights to grant this license for any content you provide.
• Content Standards: Any content you contribute must be accurate (where it states facts) and genuinely held (where it states opinions). It must not violate any third-party rights or contain any of the prohibited material outlined in the User Conduct section above. We reserve the right to remove or edit any user content that we deem inappropriate, in violation of these Terms, or for any other legitimate reason, without notice.
• No Liability for User Content: Sky Universe is not responsible or liable for user-provided content. We do not endorse any opinion, recommendation, or advice expressed by users. If you come across content provided by another user that is offensive or unlawful, please report it to us so we can review and take appropriate action.
• Monitoring: We have the right (but not the obligation) to monitor any user activity and content on our Site. We may investigate any reported violation of our Terms or complaints and take any action that we deem appropriate (such as removing content, disabling accounts, or contacting authorities). However, we do not guarantee that we will review all user content, and we assume no liability for failing to do so.

(As of now, most interactions on our Site are private – e.g., messages sent to us, or data entered in forms. Still, these principles apply to any user contributions or interactions.)

7. Intellectual Property Rights

Ownership: The Site and all of its content, features, and functionality (including text, graphics, logos, button icons, images, audio clips, video, digital downloads, data compilations, page layout, design, software, and underlying code) are the exclusive property of Sky Universe Ltd or its content suppliers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

• Sky Universe Trademarks: The company name “Sky Universe Ltd” and our logos, slogans, and related names and designs are our trademarks and service marks. You must not use these without our prior written permission. All other names, logos, or marks on the Site that are not owned by us are the property of their respective owners (for example, logos of payment providers), and are used on our Site for identification purposes only.
• Copyright: All content on the Site is our copyrighted material or used with permission. We reserve all rights not expressly granted under these Terms. You may not copy, distribute, publicly display, or create derivative works from our content without permission. However, you may temporarily download one copy of materials (like property descriptions or terms pages) for personal, non-commercial transitory viewing only. If you violate these restrictions, your right to use our Site may be terminated and you may be subject to legal action.

You should consult appropriate professionals or authoritative sources for specific advice tailored to your situation (such as legal, financial, or travel advice). We are not liable for actions you take based on information from our Site.

Site Provided “As Is”: Your use of the Site is at your own risk. The Site and all its content are provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind, either express or implied. To the fullest extent permissible under applicable law, Sky Universe Ltd disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment. For example, we cannot guarantee that a property listing will precisely meet your expectations (though we do our best to describe it accurately), or that the booking process will be completely error-free in every scenario (we will of course assist in case of any issues).

We are not responsible for the accuracy or reliability of any such third-party content. Likewise, if our Site contains user-generated content (like guest reviews), those reflect the views of the users and not necessarily our views. 9. Limitation of Liability

To the maximum extent allowed by law, in no event shall Sky Universe Ltd, its directors, officers, employees, agents, or affiliates be liable for any indirect, consequential, exemplary, incidental, or special damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your access to, use of, or inability to use the Site or its content, even if we have been advised of the possibility of such damages.

In particular, we will not be responsible for:

• Damage to Your Systems: Any damage to or viruses that may infect your computer equipment, software, data, or other property on account of your access to or use of our Site or your downloading of any material from the Site. • User Conduct: Any act or content of other users or third parties. For example, if a user harasses you via our contact form or if someone gains unauthorized access to or misuses our Site, we are not responsible for their actions (though we will take appropriate measures when we become aware).

Cap on Liability: In jurisdictions that do not allow the exclusion of certain warranties or the limitation/exclusion of liability for certain damages, our liability in such jurisdictions shall be limited to the greatest extent permitted by law. You agree to indemnify, defend, and hold harmless Sky Universe Ltd and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with: (a) your violation of these Terms; (b) your use (or misuse) of the Site (including any bookings or activities you engage in through the Site); (c) your violation of any law or the rights of a third party.

For example, if you were to scrape our site’s content and that caused us harm, or if you posted defamatory content via our Site and someone took action against us as a result, you’d be responsible for covering our costs. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you (at your expense), and you agree to cooperate with our defense of such claims. You will not settle any such claim without our prior written consent.

For instance, using a Google Map on our site binds you to Google’s Maps/Google Earth Additional Terms of Service.

12. Governing Law and Jurisdiction

These Terms of Use and any disputes arising out of or relating to the Site or these Terms (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without giving effect to any conflict of law principles that would cause the laws of another jurisdiction to apply. We choose Cyprus law because our company is registered and operates in Cyprus, and we want legal consistency for our services.

Jurisdiction: You and Sky Universe Ltd agree that any legal suits, actions, or proceedings arising out of or related to these Terms or the use of the Site shall be brought exclusively in the courts of the Republic of Cyprus. By using our Site, you consent to the jurisdiction of such courts and waive any objection to such venue on grounds of inconvenient forum or any similar grounds.

If you are a consumer residing in the European Union, you may have the right to bring proceedings in your country of residence under certain consumer protection laws. These Terms are not intended to limit any such rights that cannot be waived under local law. Additionally, as an EU consumer, you can use the EU Online Dispute Resolution (ODR) platform (accessible at ec.europa.eu/consumers/odr) which provides information about alternative dispute resolution, although we prefer to work with you directly to resolve any issues.

13. Miscellaneous Provisions

• Entire Agreement: These Terms of Use, along with our Privacy Policy, Cookie Policy, and (if you make a booking) our Booking Terms & Conditions, constitute the entire agreement between you and Sky Universe Ltd regarding your use of the Site, and supersede any prior agreements or understandings (whether oral or written) relating to the same subject matter.
• No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Sky Universe Ltd.
• Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. In other words, the invalid part will be severed, and the rest of the Terms remain valid and enforceable.
• Assignment: You may not assign or transfer any of your rights or obligations under these Terms to any third party without our prior written consent. We may assign these Terms or any rights hereunder to any third party without your consent, for example in the event of a merger, acquisition, or sale of assets. These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
• No Partnership: Nothing in these Terms shall be construed as creating any joint venture, partnership, employment, or agency relationship between you and us. Neither party has the authority to act as an agent or bind the other party in any way.
• Headings: Section headings in these Terms are for convenience only and have no legal or contractual effect.
• Language: These Terms are drawn up in the English language. If they are translated into another language, the English text shall prevail in the event of any inconsistency or ambiguity.
