These Booking Terms & Conditions (“Booking Terms”) form the basis of the contract between Sky Universe Ltd (“we”, “us” or “the Company”) and the person making a booking (“you” or “the Guest”) for short-term or long-term rental of a property. Sky Universe Ltd is a company registered in Cyprus (Registration No. HE 410403), with its registered office at Georgiou A’ 105, Sea Gate, Flat 4-2, Germasogeia 4048, Limassol, Cyprus.
Please read these Booking Terms carefully as they set out our respective rights and obligations. By making a booking with us (whether directly through our website or via phone/email or third-party platforms), you acknowledge that you have read, understood, and agree to these Terms on behalf of yourself and all persons included in the booking. If you do not agree with any part of these Terms, you should not proceed with the booking.
1. Booking Process and Contract Formation
1.1. Eligibility: To make a booking, you must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into binding contracts. You must be booking in your personal capacity or as an authorized agent for the intended guests. We reserve the right to refuse bookings at our discretion if eligibility criteria are not met.
1.2. How to Book: You can request a booking through our website’s online booking system, by emailing us, by phone, or via authorized third-party booking channels. You will need to provide necessary details such as the desired property, rental dates, number of guests, and your contact information.
All information provided must be accurate, complete, up-to-date, and capable of verification. We reserve the right to request supporting identification or confirmation of contact details where reasonably required. If any contact details are invalid, misleading, or false, we reserve the right to reject or cancel the booking without liability.
1.3. Booking Confirmation and Contract Formation: Submitting a booking request (online or otherwise) does not mean your booking is confirmed. Your booking is only confirmed, and a binding contract between us only comes into existence, when the following conditions have been met (whichever occurs earliest):
a. We have accepted your booking request and sent you a written Booking Confirmation by email (or other text) detailing the rental specifics (property, dates, price, etc.); and b. You have paid the required booking deposit (or full payment, as applicable) and we have acknowledged receipt of that payment; or
c. You have provided payment details and we have charged the full cost of the rental to your card (in cases where full upfront payment is required at booking).
At that point, a contract will exist between you and Sky Universe Ltd on these Terms. We will also issue or reference our Booking Confirmation Number which you should use in any communications.
1.4. If We Do Not Confirm: In the unlikely event we cannot accept or fulfill your booking (for example, due to unavailability, a technical pricing error, failure to meet eligibility requirements, or non-compliance with these Terms), we will inform you as soon as possible. No payment will be taken, or any amount collected will be refunded.
We reserve the right to decline a booking request at our discretion, including (without limitation) where you do not meet the age requirements, where the property is not suitable for your group size, where inaccurate or misleading information has been provided, or where the booking otherwise does not comply with these Terms. No contract is formed until confirmation as per clause 1.3.
1.5. Group Bookings: The person who makes the booking (“Lead Guest”) is responsible for ensuring all members of the party are aware of and comply with these Terms. The Lead Guest shall be deemed to have authority to act on behalf of all other guests in the party. All correspondence will be sent to the Lead Guest, who shall inform the rest of the party as appropriate.
2. Prices and Payment
2.1. Rental Price: The price of your rental is as quoted at the time of booking (either on our website or as communicated by us). Prices are per property, not per person, unless stated otherwise. All prices include applicable taxes (e.g., VAT) unless stated. We endeavor to ensure pricing and information on our website are correct; however, we reserve the right to correct obvious errors. If a pricing error is discovered after you’ve made a booking but before we confirmed it, we will contact you to either reconfirm at the correct price or allow you to cancel for a full refund.
2.2. Deposit: At the time of booking, you are required to pay a deposit equal to 30% of the total rental cost to secure the reservation. The deposit is applied toward the total rental price.
If you cancel more than 30 days before the arrival date, we will refund all amounts paid.
If you cancel 30 days or less before the arrival date, we will retain the deposit (30%) and refund any amount paid above the deposit, subject always to clause 5.2 (7 days or less).
Payment of the deposit constitutes your acceptance of these Booking Terms on behalf of all persons included in the booking.
2.3. Balance Payment: The remaining balance of the rental cost (total price minus the deposit paid) must be paid in full no later than 7 days before the arrival date, unless otherwise specified in your Booking Confirmation. If the booking is made within 30 days of arrival, we may require full payment at the time of booking (or, in the case of bank transfer, within the short grace period referred to in clause 2.4). If the balance is not paid by the due date, we may treat the booking as cancelled by you and the cancellation terms in Section 5 will apply.
2.4. Payment Methods: We accept major credit/debit cards for online or phone payments (Visa, MasterCard, etc.), as well as bank wire transfers. If paying by credit card, your card will be charged in the currency stated (e.g., Euros) and you are responsible for any currency conversion fees imposed by your bank. If paying by bank transfer, we will provide our bank details. Any bank charges or fees (including international transfer fees) must be covered by you. For bank transfers, your booking remains tentative until funds have cleared. We typically allow a grace period (e.g., 5 working days) for the transfer to arrive. If funds are not received within that period, we reserve the right to cancel the booking.
2.5. Failure to Pay: It is your responsibility to ensure that all payments are made on time. If we do not receive the balance payment by the due date (as per clause 2.3 or your Booking Confirmation), we reserve the right to treat the booking as cancelled by you, in which case Section 5 will apply. We may attempt to contact you and may allow a short grace period; however, we are not obliged to hold the booking if payment is not received.
2.6. Included/Excluded Charges: The rental price includes accommodation for the stated number of nights and allowable guests, and the use of utilities (water and electricity), unless otherwise specified. Departure cleaning is included in the price of the stay. However, excessive cleaning requirements beyond normal use may be charged against your security deposit (see Section 3).
Some properties may offer additional services (such as cleaning during the stay or transfer arrangements) either included or at extra cost. These will be detailed in the property description or booking confirmation. Tourist taxes or VAT are included where applicable. If any fees are not included (for example, a local city tax payable on arrival or optional extras such as pool heating or equipment rental), we will inform you at the time of booking or prior to arrival.
2.7. Accuracy of Prices: We reserve the right to revise prices on our website at any time. Once you have booked, however, your agreed price is fixed and will not change except in cases of obvious error or changes in tax law. If a price reduction is advertised after your booking is confirmed, you will not be entitled to a refund of the difference. Conversely, we will not charge you more if prices are increased after your booking has been confirmed.
3. Security Deposit and Damage Policy
3.1. Guest Responsibility: You (the booking guest and your party) are expected to treat the rental property with care and respect. You are responsible for any damage or loss to the property or its contents during your stay, beyond normal wear and tear. This includes responsibility for the actions of all members of your party and any visitors you invite to the property. If you notice any pre-existing damage or issues at check-in, please report them to us or the property manager immediately to avoid disputes.
3.2. Security Deposit Requirement: Many of our properties require a refundable security deposit to cover potential damages or losses. If a security deposit is required for your booking, the amount and due date will be specified in your booking confirmation (often as a flat amount depending on the property size and value).
Typically, the security deposit must be paid together with the final balance or prior to arrival, as specified in your confirmation. We may also allow a credit card pre-authorization (hold) in lieu of an actual charge; if so, full details will be provided in advance.
3.3. Use of Security Deposit: The security deposit may be used to cover:
(a) the cost of any property damage or loss caused by you or your party;
(b) excessive cleaning costs where the property is left in an unreasonably unclean or untidy condition; and/or
(c) unpaid charges or fees (for example, pay-per-use services consumed during your stay or fines incurred due to your actions).
The deposit does not apply to normal cleaning or reasonable wear and tear. We will document any damages with photos and/or receipts where reasonably possible.
3.4. During Your Stay: You agree to promptly notify us or the local property manager of any damage or issues occurring during your stay. You must not attempt to repair any damage yourself without prior authorization (except in an emergency to prevent further damage). Prompt reporting may help reduce repair costs and avoid additional charges.
3.5. Refund of Security Deposit: If a security deposit was collected, it will be refunded after your stay provided no deductions are required. We aim to process refunds within 0–7 days after check-out, once the property has been inspected and cleared.
Refunds will be made to the original payment method where possible (for example, release of card pre-authorization or refund to the card used). If paid by bank transfer, we will transfer the funds back to your account. While we initiate refunds promptly, processing times may vary depending on the relevant bank or card provider.
3.6. Deductions from Deposit: If we determine there are chargeable damages or losses, we will inform you as soon as possible, providing an itemized list of deductions and the reasons. We will deduct the cost of repair or replacement from the deposit. For example, if a lamp is broken, we will deduct the cost of a similar replacement; if extra cleaning is required beyond normal (e.g., property left excessively dirty, requiring additional cleaner hours or specialist cleaning), we will deduct a reasonable fee. If the deposit is insufficient to cover the damages, we reserve the right to invoice you for the additional costs, which you agree to pay upon receipt. We may charge the card on file for such costs if not otherwise settled.
3.7. Dispute Resolution: In the event of a dispute over damage charges, we prefer to resolve amicably. We will provide evidence (photos, receipts) and discuss with you. If mutual agreement cannot be reached, the matter can be referred to an independent third-party arbitrator or small claims court as appropriate in Cyprus jurisdiction. Until resolved, we may hold the contested portion of the deposit.
3.8. Insurance: We strongly encourage guests to carry travel insurance that covers accidental damage to rental properties. Some travel insurance or damage waiver products can cover such incidents, which may provide you peace of mind. Check your policy; if you have coverage, you can potentially claim through insurance for any significant accidental damage. Regardless, you remain responsible to us as per this section, but insurance might reimburse you.
4. Changes and Special Requests
4.1. Guest Changes (Before Arrival): If you wish to make a change to your confirmed booking (such as a different property, altered dates, or a reduced length of stay), you must request this in writing (email is acceptable) as soon as possible. We will do our best to accommodate, but changes are not guaranteed and are subject to availability and our discretion. Changes to dates or property are effectively a cancellation of the original booking and a new booking, so see Section 5 for potential charges if dates are moved or shortened (especially close to arrival). Minor changes, like adding extra guests (within the property’s capacity) or requesting additional services, will typically be allowed, but may incur additional costs (e.g., extra guest fee or service charge). All changes must be agreed by us in writing.
4.2. Name Changes: If the Lead Guest name needs to change (e.g., if you can’t travel and a friend is taking over the booking), this might be treated as a cancellation by you and new booking by them. However, if at least one original party member remains and it’s just a substitution, we may allow it with our consent. The new lead person must accept these Terms and be eligible. Significant changes less than 7 days before arrival may not be allowed for security reasons.
4.3. Extending Your Stay: If you wish to extend your stay (either arrive earlier or depart later than originally booked), please contact us. We will accommodate if the property is available and the owner agrees. Additional nights will be charged at the applicable rate. If you decide during your stay that you want to stay longer and the property is free, we’ll do our best to offer an extension (with payment due immediately for the extra nights).
4.4. Changes by Us: We aim to provide the property and arrangements as confirmed. However, in rare cases, we may need to make changes due to unforeseen circumstances (for example, urgent maintenance issues at the property or the owner withdrawing the property from rental). If such a situation occurs, we will inform you as soon as reasonably possible.
- Minor Changes: If the change is minor (meaning it does not significantly affect your stay), we will notify you, and no compensation or refund will be due. For example, a listed amenity may be temporarily unavailable (such as a dishwasher requiring repair) or there may be minor construction nearby causing daytime noise. We will use reasonable efforts to minimize any inconvenience.
- Significant Changes: If a significant change becomes necessary (for example, the property becomes unavailable or uninhabitable for your booked dates), we will notify you as soon as possible. In such cases, you may choose to either:
(a) accept the change, which may include relocation to a comparable alternative property (subject to availability) at no extra cost; or
(b) cancel the booking and receive a full refund of all amounts paid.
A change will generally be considered “significant” if, for example, the alternative property offered is of materially lower standard, is in a different location, or if your check-in date must be changed by more than 48 hours. If you accept an alternative property of higher value, you may be required to pay the difference, unless we agree otherwise. If you decline available alternatives of comparable standard, our liability will be limited to refunding the amounts you have paid.
4.5. No Compensation for Changes: If we make a significant change or cancelation and refund you as above, that will typically be the full extent of our liability. We will not be liable for any additional compensation or consequential losses (such as the cost of flights, car rentals, or other arrangements affected) in cases where changes are due to reasons beyond our control (see Force Majeure in Section 7) or necessary for safety/maintenance. We strongly recommend you have travel insurance that can cover ancillary losses if a rental is canceled.
4.6. Special Requests: Any special requests (e.g., specific floor level, early check-in, late check-out, baby cot, etc.) should be made at the time of booking. While we will note and attempt to meet reasonable requests, we cannot guarantee that every request will be fulfilled unless we expressly confirm it. Special requests are not part of the contract unless explicitly confirmed by us in writing. Lack of availability of a special request (like a late check-out) is not a breach of contract on our part, but we’ll do our best to accommodate when possible.
5. Cancellation Policy
5.1 Your Rights to Cancel: If you need to cancel your booking, the cancellation must be made in writing by the Lead Guest (email is acceptable, to booking@skyuniverse.com) and will be effective on the date we receive it. The following cancellation terms apply:
5.2. Cancellation Charges:
(a) More than 30 days before check-in: Full refund of all amounts paid.
(b) 30 days or less before check-in: We will retain 30% of the total rental price (the deposit). Any amount paid above 30% will be refunded.
(c) 7 days or less before check-in: The full rental price is due and non-refundable. If the balance has not yet been paid, we reserve the right to charge or otherwise collect the outstanding amount.
5.3. Re-Letting / Goodwill Refund: If you cancel within the period where the booking is non-refundable, we may (at our discretion) attempt to re-let the property. If we successfully rebook some or all of the cancelled nights, we may offer a partial refund (less reasonable administrative costs and any price difference). We are not obliged to re-let or to provide any refund beyond clause 5.2.
5.4. Extenuating Circumstances: If you have to cancel due to serious unforeseen circumstances beyond your control (e.g., a medical emergency, death in the family, government travel ban, etc.), please inform us with appropriate documentation. We will try to be compassionate and may offer flexibility (like a credit for a future stay, or partial refund) even if it’s within the non-refundable period. This is not guaranteed and is assessed case-by-case. We encourage travel insurance to cover these instances, as our standard policy will apply absent special consideration.
5.5. No-Shows and Early Departures: If you do not arrive on the scheduled check-in date without prior notice (“no-show”), it will be treated as a cancellation with no refund. Similarly, if you voluntarily vacate the property earlier than your scheduled check-out date, no refunds will be given for the unused nights. (Example: If you booked 7 nights and leave after 5 nights, you won’t get a refund for the last 2 nights.) We strongly recommend travel insurance to cover trip curtailment scenarios.
5.6. Cancellation by Us: In the rare event we cancel your booking for reasons other than your breach (e.g., serious property issues, owner withdrawal) and not due to force majeure, we will refund all monies paid and, where appropriate, assist in finding alternative accommodation. Section 4.4 covers significant changes/cancellations by us. If cancellation is due to your violation of these Terms (e.g., fraud, misrepresentation, or abusive behavior), no refund is due and we reserve all rights.
5.7. Travel Insurance: We strongly advise that you purchase comprehensive travel insurance at the time of booking that covers cancellations, medical expenses, personal liability, and belongings. Your insurance should ideally cover situations like illness (including COVID-19 related disruptions, if still applicable), airline cancellations, or other emergencies that might prevent or cut short your trip. Our cancellation policy will be enforced regardless of personal circumstances (except extreme cases per 5.4), so insurance is your safeguard to recoup funds in those scenarios.
6. Check-In, Stay, and Check-Out
6.1. Check-In Procedure: Check-in details (such as address, key pickup, or meet-and-greet arrangements) will be provided to you a few days before arrival or upon full payment. Generally:
- Check-in Time: From 15:00 (3:00 PM) on the arrival date, unless otherwise stated. Early check-in is subject to availability and may incur an extra fee. You must request it in advance so we can confirm if possible.
- We may have a representative meet you at the property to hand over keys and show you around, or we might use a lockbox/keycode system. You will need to show a valid ID (passport or national ID) matching the booking name for security.
Late Arrival: If you plan to arrive after the designated check-in time (often 20:00 / 8:00 PM), please inform us in advance so we can accommodate you. Late arrivals may incur a surcharge if staff are required to meet you outside normal working hours (we will notify you of any such fee in advance).
Where feasible, we may arrange a self-check-in method, and full self-check-in instructions will be provided to you prior to arrival.
6.2. Check-Out Procedure:
- Check-out Time: By 11:00 AM on the departure date, unless otherwise agreed in writing. Late check-out may be arranged subject to availability and may incur an additional fee. Unauthorized late check-out may result in extra charges.
- On departure, you must leave the property in a reasonably tidy condition: wash used dishes, remove excessive rubbish, return furniture to its original position if moved, and ensure all equipment used during your stay is returned and stored in its designated place (for example, pool or beach equipment must be collected and properly stored before departure). All keys, access cards and similar items must be returned as instructed.
- We will inspect the property shortly after your departure. Provided no major issue is identified, the security deposit will be refunded in accordance with Section 3.
6.3. During Your Stay – Our Obligations:
We will ensure the property is cleaned and prepared prior to your arrival. Fresh linens and towels will be provided (one set per person, unless otherwise stated). Basic utilities (water, electricity, heating/cooling) will be operational. Pool and garden maintenance (where applicable) will occur as scheduled, and we will notify you if access is required.
If any appliance or facility malfunctions during your stay, please notify us and we will arrange repair or replacement as soon as reasonably possible.
6.4. Your Use of Property: The rental property is to be used solely as private temporary accommodation for you and the guests named in the booking.
You must not use the property for any commercial activity (including photoshoots, events, or similar activities) without prior written permission. Organizing parties, gatherings, or events of any kind, and inviting non-registered guests to the property, is strictly prohibited.
You agree to abide by all house rules provided (whether listed in the property description or in the information pack). Common rules include respecting quiet hours (particularly between 22:00 and 08:00), no indoor smoking (unless otherwise stated), and proper use of all appliances and facilities.
6.5. Maximum Occupancy and Visitors: Only the persons named in the booking confirmation are permitted to stay at the property. The total number of occupants must not exceed the maximum occupancy stated in your confirmation.
Visitors are not permitted without prior approval. Where visitors are exceptionally allowed, the number of persons present at the property at any time must not exceed the number of guests stated in the booking confirmation. Overnight stays by non-registered guests are strictly prohibited unless expressly agreed in writing.
Over-occupancy, misrepresentation of party size, or breach of the above restrictions constitutes a serious violation of these Terms and may result in immediate termination of the stay without refund.
6.6. Noise and Neighborly Conduct: Please be respectful of neighbors. Many properties are located in residential areas; excessive noise, loud music, disruptive behavior, or any activity likely to disturb neighbors is prohibited.
If complaints are received or authorities are called due to disturbance caused by your party, this will be treated as a material breach of these Terms and may result in immediate eviction without refund.
6.7. No Illegal or Unsafe Activities: You must not engage in any illegal activities on the premises. This includes, without limitation, gambling, prostitution, possession or use of illegal substances, or storing hazardous materials or weapons at the property.
If illegal substances are used, detected, or reported (including by neighbors or authorities), this may result in immediate eviction without refund and, where appropriate, notification of the relevant authorities.
6.8. Smoking and Pets:
- Smoking: All properties are non-smoking indoors unless explicitly designated otherwise. Smoking is permitted only in approved outdoor areas (e.g., balcony or garden) and must not disturb neighbors. Cigarette butts must be properly disposed of.
If indoor smoking is detected (including evidence such as smell, burns, stains or residue), additional cleaning or restoration costs may apply and may be deducted from your security deposit. This may include, without limitation, deep cleaning, upholstery cleaning, repainting, deodorizing treatments, or replacement of damaged furnishings.
- Pets: Pets are not permitted unless prior written approval has been granted. Some properties may allow pets on a case-by-case basis and may require an additional cleaning fee.
If an unauthorized pet is brought to the property, we reserve the right to impose additional cleaning charges and/or require removal of the pet. Continued breach may result in termination of the stay without refund.
6.9. Maintenance and Access: We reserve the right for ourselves or our authorized representatives to access the property during your stay for urgent maintenance, necessary repairs, or inspections (for example, fixing a broken appliance or carrying out pool maintenance).
We will provide reasonable notice wherever possible and aim to schedule access at a convenient time. In emergencies (such as water leaks or safety risks), we may enter immediately if you cannot be reached. We will always respect your privacy and only enter when reasonably necessary.
6.10. Housekeeping: The property will be cleaned prior to your arrival. For stays longer than one week, interim housekeeping or linen changes may be offered or included, and details will be confirmed in your booking.
You are responsible for maintaining the property in a reasonably clean and orderly condition during your stay (e.g., washing dishes, removing rubbish, basic upkeep). We provide an initial supply of consumables (such as toilet paper, soap and basic cleaning supplies). For longer stays, you may be required to replenish these items as needed.
6.11. Utilities Use: Please use water and electricity responsibly (Cyprus can have high utility costs and water scarcity). Do not leave A/C running when doors/windows are open or when you leave the property. Excessive or irresponsible use that results in abnormally high utility bills may be charged (this is rare and would require extreme usage outside normal range).
6.12. Pool and Facilities: If the property has a pool or hot tub, use is at your own risk. Follow any posted rules (like showering before use, no glass near pool). Children must be supervised at all times around water. We cannot be liable for accidents—please take precautions. Similarly, if there is a BBQ, use carefully and never leave it unattended while lit. Ensure coals are fully extinguished. Any facility provided should be used properly and at your risk.
6.13. Reporting Issues: If during your stay you notice any problems (e.g., appliance breakdown, something not as expected), please notify us or our local manager immediately. We will make efforts to fix or mitigate the issue promptly. Do not wait until check-out to report dissatisfaction – we want to help during your stay. Any complaints not reported during stay, which we had no chance to resolve, might not be compensated later.
6.14. Eviction: We reserve the right to evict you and your party without refund if you seriously breach these Terms or the property’s house rules. Grounds for eviction include: exceeding occupancy, hosting a forbidden party/event, causing significant nuisance to neighbors, damage to property, illegal activities, or any behavior that in our reasonable opinion is likely to cause harm to the property or reputation of Sky Universe. In such cases, we may also charge additional fees for damage or disruption as appropriate and you may forfeit any unused nights.
7. Force Majeure
7.1. Definition: Force Majeure refers to any event outside our reasonable control that prevents or significantly hinders the performance of our obligations under this contract. Such events include, but are not limited to: natural disasters (e.g., earthquakes, floods, hurricanes), fires, explosions, war or acts of terrorism, civil unrest or riots, strikes or labor disputes, epidemics or pandemics and related government measures (travel bans, lockdowns), closure of borders or transportation systems, and interruption of utilities (water/electricity outages).
7.2. Consequences: If a Force Majeure event occurs that makes it impossible or illegal for the booking to be fulfilled (e.g., government prohibits short-term rentals or travel to the area, or property is rendered uninhabitable by disaster), both parties shall not be deemed in breach of these Terms. We will inform you as soon as reasonably possible if such an event affects your booking.
- If the stay has not yet commenced, we may offer to postpone your booking (reschedule to a later date) or, if that’s not feasible, cancel and refund you. Note that if you are already in residence and a force majeure event requires evacuation or early termination, we will refund unused nights or assist in finding alternative lodging, as the case may be.
- We do not accept liability or pay compensation for losses caused by force majeure. It’s understood neither we nor you could foresee or prevent the event. We strongly advise you obtain travel insurance that covers such scenarios (some policies cover natural disasters or pandemics, etc.).
7.3. Pandemic/Health Measures: In light of recent global events (like COVID-19), please be aware that government health measures (quarantines, lockdowns) can constitute force majeure. However, disinclination to travel or general concerns are not force majeure if travel is still legally possible. We will handle pandemic-related cancellations in line with our cancellation policy unless official restrictions mandate closure/cancellation.
7.4. Duty to Mitigate: Each party will use reasonable efforts to mitigate the impact of the force majeure. For example, if an alternate property or solution can be arranged, we will attempt to find one. If you can travel on alternative dates, we’ll try to reschedule. Communication is key.
7.5. No Automatic Right: A force majeure event does not automatically give you a right to a refund if the contract can still be performed (e.g., if the property is fine and open but you personally decide not to travel due to worry). Standard cancellation terms would apply in such personal decision cases. Force majeure applies when performance is truly prevented or illegal, not just inconvenient.
8. Liability and Guest Safety
8.1. Our Liability: We will not be liable for any injury, illness, death, loss, damage, or expense which you or any member of your party may suffer during your stay, except where such loss or damage is directly due to our negligence or failure to perform our obligations. To the fullest extent permitted by law, we exclude liability for any indirect or consequential losses (for example, loss of enjoyment, or costs of alternative accommodation if you fail to adhere to these terms). If we are found liable for anything, our maximum liability is limited to the total amount paid for your booking.
8.2. Personal Belongings: You are responsible for the security of your own belongings during the stay. Ensure doors and windows are locked when you’re out. We are not responsible for theft or loss of your personal items. Any valuables left behind or forgotten are at your own risk; we’ll try to assist in recovering lost items but cannot guarantee it. Travel insurance should cover personal property loss.
8.3. Facilities and Amenities: We do our best to ensure all amenities (pool, gym equipment, appliances) are safe and in working order, but use of these is at your own risk. For instance, use the swimming pool responsibly; children must be supervised at all times around the pool. We cannot be held liable for accidents if normal safety precautions are not observed by guests. Similarly, any provided recreational equipment (bicycles, etc.) is used at your own risk – please use helmets and appropriate safety gear.
8.4. Allergies and Sensitivities: If you or your guests have allergies (to pets, detergents, etc.), inform us in advance. We clean properties to a high standard, but cannot guarantee an allergen-free environment. For example, a “no pets” property may still have had pets at some point and could trigger allergies. We accept no liability for allergic reactions or health issues arising from environmental factors beyond our control.
8.5. Building Work: Occasionally there may be construction or building work in the vicinity of the rental property (e.g., a neighbor renovating) which is outside our control and not known at time of booking. We regret any inconvenience such noise may cause, but we cannot be held liable for this disruption. If we become aware of significant construction that will seriously impact your stay, we will inform you and, if appropriate, offer alternatives (per Section 4.4 on significant changes).
8.6. Limitations for Long-Term Stays: If your stay is a longer-term rental (several months), note that this may be governed by slightly different legal regime (e.g., if surpassing certain length might be considered a tenancy). However, by agreeing to these terms for a long stay, you acknowledge it remains a temporary furnished accommodation and not a primary residence lease. Our liability for long stays remains as set out here; we are not your landlord in a traditional sense and these terms still apply.
8.7. Indemnity: You agree to indemnify and hold us harmless from any claim or liability (including legal fees) arising out of your or your party’s actions during the stay. For example, if you break a law or cause serious damage and a claim is made against us as property owner/manager, you will cover our costs.
8.8. Insurance (Our and Yours): The property itself is insured for certain risks (fire, etc.), but this insurance does not cover your personal belongings or liability. That’s why we insist on you having travel insurance. Our insurance also may not cover negligent or willful damage you cause; you’d be liable for those costs. By booking, you confirm you have considered insurance to protect yourself (and inform your guests accordingly).
8.9. Complaints and Issues: If you have a complaint during your stay (e.g., cleanliness issues, missing amenities), you must allow us a reasonable opportunity to address it by notifying us promptly. We are committed to resolving legitimate complaints on-site if possible. Complaints raised only after checkout or refusal of offered solutions at the time may affect your right to compensation. In any case, any compensation for inconvenience (if warranted) will be reasonable and proportionate to the issue (for instance, a minor issue won’t merit a full refund of your stay).
8.10. Statutory Rights: Nothing in these Terms affects your statutory rights as a consumer under applicable law. If any terms here are found to be unfair or unenforceable under local consumer law, that part shall be deemed severed, but the rest of the terms remain in effect.
9. Complaints and Dispute Resolution
9.1. Complaints During Stay: As noted, notify us immediately of any issue so we can attempt to resolve it while you’re here. We have a local team and contacts for maintenance, and we genuinely want you to have a great stay. Common issues can often be fixed quickly (like replacing a broken appliance or adjusting cleaning). We aim to resolve complaints within 48 hours when feasible.
9.2. Post-Stay Complaints: If you have a complaint or claim that could not be raised during the stay (or wasn’t satisfactorily resolved), you must send it to us in writing within 7 days of the end of your stay. Provide full details and any evidence. We will investigate and respond within 14 days of receipt. We may request further information or proof. Our goal is to reach an amicable resolution. Please note that delay in raising issues can hinder our ability to investigate (e.g., if reported weeks later, the condition of property may have changed).
9.3. Mediation/ADR: If we cannot reach a mutual agreement on a dispute, we can consider alternative dispute resolution. As a Cyprus-based company, we are open to mediation through the Cyprus Consumer Center for ADR or similar recognized body for consumer disputes. Additionally, EU residents can use the EU Online Dispute Resolution (ODR) platform to facilitate communications, but we prefer direct resolution. Engaging in mediation does not waive the right to later pursue court action if needed.
9.4. Legal Proceedings: If a dispute cannot be resolved amicably, the matter will be governed by Cyprus law and brought in Cyprus courts as per Section 12 of the Terms of Use (which is incorporated here). We both agree to exclusive jurisdiction of Cyprus courts for any litigation arising from the booking or these Terms.
9.5. Recovery of Costs: If enforcement action is needed to recover monies due (for example, unpaid damages beyond security deposit), we will seek to recover those costs and the legal fees associated. Conversely, if you initiate a claim and substantially prevail, you may seek to recover reasonable legal costs as allowed by law.
9.6. Feedback: This is not a dispute item, but we welcome general feedback and reviews. After your stay, you might receive a survey or request for a review/testimonial. While optional, we value your input to improve our services. Any provided testimonials could be used on our website (with first name or initials for privacy). If you have private constructive feedback, feel free to email us.
10. Privacy and Data Protection
10.1. Use of Personal Data: We will handle all personal data in accordance with our Privacy Policy (provided separately on our website and earlier in this document). In brief, we collect only necessary personal information to manage your booking (names, contact info, payment details, and any special requirements). We may share relevant details with service providers (like the local property manager/owner or cleaning team) strictly as needed to fulfill your rental. All such parties are bound to confidentiality and data protection standards.
10.2. ID Laws: In some jurisdictions (including Cyprus), hosts are required to register guest details (e.g., passport numbers) with authorities (for tourism statistics or immigration rules). You agree to provide any legally required identification information upon request for such purposes. We will only use it to comply with law and secure it appropriately.
10.3. Payment Security: Online payments are processed securely via reputable payment gateways, and we do not store your full card info (only tokens or last 4 as needed). For bank transfers, our bank is secure but be vigilant against fraud (always confirm you’re sending to our official account as provided; if in doubt, contact us).
10.4. CCTV: Some properties in our portfolio may have external CCTV cameras for security (e.g., at the entrance or driveway). If so, you’ll be informed, and these are solely for security of the property. There are no cameras or recording devices inside the property or in private areas (like pool or garden) – doing so would violate privacy laws and our standards.
10.5. Marketing: We might send you future offers or newsletters if you opted in. You can opt out anytime. We do not sell or share your data for third-party marketing.
10.6. GDPR Rights: In accordance with the General Data Protection Regulation (GDPR), if you are an EU data subject, you have the right to access, rectify, erase, restrict or object to the processing of your personal data, as well as other rights provided under applicable data protection law.
